IRS Notice 2010-84 – “In-Plan” Roth Conversion Guidance Webcast
As anticipated, the IRS has issued additional guidance on the new in-plan Roth conversion option created by the Small Business Jobs Act of 2010 (SBJA). IRS Notice 2010-84, released by the IRS on Friday, November 26, 2010, provides extensive guidance concerning the options and requirements applicable to plan sponsors that wish to add an in-plan Roth conversion option.
Given the special tax-split option available for 2010 Roth conversions, some plan sponsors are hoping to add an in-plan Roth conversion option to their plan before year end. While the desire to add an in-plan Roth conversion option before year end is understandable, the challenges for both plan providers and plan sponsors will be formidable.
Regardless of product and/or systems limitations, plan providers and investment providers alike must be prepared with informed responses to the in-plan Roth conversion questions that are likely to arise from both the plan sponsor and the plan advisor communities as we approach year end.
